Terms of Service

1. Acceptance of Terms

By accessing or using Q by Wentzel ("the Service"), operated by Wentzel ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Q by Wentzel provides post-quantum cryptography assessment tools including, but not limited to, network scanning, Harvest Now Decrypt Later (HNDL) risk scoring, Cryptographic Bill of Materials (CBOM) generation, and adversarial testing capabilities. The Service is designed to help organizations identify and remediate cryptographic vulnerabilities in preparation for the quantum computing era.

3. Authorized Use

You must have explicit authorization to scan any target systems using our Service. Unauthorized scanning of networks, systems, or infrastructure that you do not own or have written permission to test is strictly prohibited. You are solely responsible for ensuring that you have obtained all necessary authorizations before initiating any scan operations. Violation of this provision may result in immediate termination of your account and may expose you to civil and criminal liability.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including API keys and access tokens. You agree to immediately notify us of any unauthorized use of your account. You are responsible for all activities that occur under your account, whether or not authorized by you. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Scan, probe, or test any system or network without proper authorization from the system owner.
  • Engage in any activity that is illegal, harmful, or could damage, disable, or impair the Service or any third-party systems.
  • Attempt to reverse engineer, decompile, or disassemble any portion of the Service, including our scanning algorithms, scoring models, or detection engines.
  • Use the Service to develop a competing product or service.
  • Share, resell, or redistribute scan results, reports, or data generated by the Service without our prior written consent, except for internal use within your organization.
  • Exceed rate limits or otherwise abuse the Service in a manner that degrades performance for other users.

6. Data Handling

We process scan data to provide assessment results. Scan targets, configurations, and results are stored securely and associated with your organization. We implement industry-standard encryption and access controls to protect your data. We do not sell or share your scan data with third parties, except as required to provide the Service or as required by law. You retain ownership of all data you submit to the Service, including scan configurations and target specifications. We retain scan results and assessment data for the duration of your subscription, plus a reasonable period thereafter for archival purposes.

7. Intellectual Property

The Service, including all software, algorithms, scoring models, user interfaces, documentation, and other materials, is the intellectual property of Wentzel and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade names. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

8. Limitation of Liability

Security testing involves inherent risks, including the potential for service disruption on scanned systems. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including damages resulting from scan operations you authorize, loss of data, business interruption, or any other commercial damages or losses. Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the Service during the twelve months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access to the Service immediately, without prior notice, if we reasonably believe you have violated these Terms, including but not limited to unauthorized scanning activity. Upon termination, your right to use the Service will immediately cease. We will make your scan data available for export for a period of thirty (30) days following termination, after which we may delete it.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Service.
